Terms & Conditions
These terms & conditions govern the use of guineys.ie and your relationship with Michael Guiney Limited (trading as "Guineys"), a company registered in Ireland (Company Registration No. 34465), with its registered office at 11/12 North Earl Street, Dublin 1, D01XT26. 1. Use of this website – This website, Guineys.ie, is provided to you for your personal, non-commercial use subject to the below terms & conditions. By using this website you agree to be bound by these terms & conditions.
2. Changes to these terms – These Terms & Conditions are subject to change from time to time for legal, regulatory or operational reasons. The version in force at the time you place your order is the version that applies to that order.
3. Availability of the website – We aim to offer the best shopping experience but we make no promise that the use of this site will be fault free. If you notice any fault please contact us at [email protected] and we will try to remedy the issue as soon as we can. From time to time, this site will require maintenance at which time access will be restricted.
4. Prices – All prices are in Euro and inclusive of VAT. Delivery charges, where applicable, are shown at checkout before you confirm your order. Your order is an offer to buy from us. There will be no contract of any kind between you and us until we have actually dispatched the goods to you. At any point up until then, we may decline your order; if we do so, you will not be charged (or any payment taken will be refunded in full). At the moment your goods are dispatched, a contract will be made between you and us, and you will be charged for your goods. If, in the unlikely event, we have priced an item incorrectly, we will not be liable to supply that item to you at the stated price as long as we notify you before we dispatch the relevant item. In that case we will give you the option to confirm your order at the correct price or cancel it for a full refund.
5. Availability of goods – If for any reason we are unable to fulfil your order with a particular item, we will notify you and ensure that you are not charged for that item (or that any payment taken for it is refunded).
6. Delivery – Delivery will be made to the address specified by you at the checkout. Next day delivery is available for deliveries in Ireland only. Orders must be placed before 12pm (noon) for delivery the following day. The following day means the following working day, Monday to Friday excluding Bank Holidays. Although we offer a next day delivery service, we can't be held responsible for delays outside of our control. Please ensure your address, Eircode and phone number are correct. Please note that packaging may indicate or reveal the contents of your order. If you would like the contents of your parcel to be concealed (for example, if the order is a gift or a surprise), please let us know at the time of ordering or by emailing [email protected] and we will do our best to hide that information. If your order is not received, you must notify us in writing or by email within 30 days of dispatch so that we can investigate with the carrier. 7. Returns – If for any reason you are unhappy with your purchase, you may cancel & return your order within 28 days of the delivery of your order. This is in addition to your statutory right under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013 to cancel your order, without giving any reason, within 14 days of the day you receive the goods. Free returns are available for customers in the Republic of Ireland only when using An Post's Click & Post service only, as outlined in our returns policy. We will not reimburse postage if you use any other service. Otherwise, you will be responsible for the return of any unwanted item unless the item is defective or we have sent the item to you in error. Refunds will be made within 14 days of us receiving the goods back (or receiving proof that you have sent them back), using the same payment method you used. We may reduce your refund to reflect any diminished value of the goods caused by handling beyond what is necessary to establish their nature, characteristics and functioning. Certain items are excluded from the change-of-mind right for hygiene reasons where they have been unsealed after delivery (for example pillows, duvets and bedding removed from sealed packaging); this does not affect your rights in respect of faulty goods. 8. Faulty goods – Under the Consumer Rights Act 2022, goods we supply must be of the quality you are entitled to expect, fit for purpose and as described. If goods are faulty, you may be entitled to a repair, replacement, price reduction or refund, depending on the circumstances. Within 30 days of delivery, you may reject faulty goods and receive a full refund. Where goods are faulty or were sent in error, we will cover the reasonable cost of return – see our returns policy for how to arrange this. Nothing in these terms & conditions affects your statutory rights.
9. Cancellation or changes of order prior to dispatch – You can ask to change or cancel your order prior to dispatch by contacting us at [email protected]. Because orders are processed quickly, we can't guarantee that we will be able to change or cancel your order, so please check your order details carefully before submitting. If we cannot change or cancel your order before dispatch, you can still return it under clause 7 once delivered.
10. Delivery address – We can't change the delivery address of your order once your order has been shipped.
11. Carriers – By placing an order, you consent to An Post, DPD or other third party carriers (including carriers used by our dropshipping partners) contacting you in relation to the delivery of your order.
12. Promotion codes and gift vouchers – Only one promotion code or gift voucher code, regardless of its origin, can be redeemed against any one order. Promotions apply only to, and are redeemable only against, orders made online, unless otherwise stated in the offer terms.
13. Special offers – Please note Special Offer prices are only valid if the item is purchased at the Offer price, during the life of the Special Offer. We will not offer a refund for the price difference between the offer price and the non-offer price on goods included in the offer, but purchased outside the terms of the offer. 14. Data protection – We process your personal data in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Acts 1988 to 2018. We do not share your details with third parties except where necessary to fulfil your order (for example with payment providers and delivery carriers), where you have given consent, or where we have a lawful basis to do so. 15. Security checks – Orders may be subject to extra security checks at our discretion. This may include confirmation of Credit/Debit card details and full address details. We reserve the right to request payment by an alternative method or cancel any orders if this information cannot be supplied.
16. Refusal of orders – We reserve the right to cancel or refuse orders at the discretion of our management, for example where we suspect fraud. Where an order is cancelled, any payment taken will be refunded in full.
17. Contacting you – We reserve the right to contact customers regarding orders and purchases made from Guineys.
18. Free and promotional items – We will not cover return postage in relation to "free" or "promotional" or "gift with purchase" items provided with purchase which are returned to our premises, unless those items are faulty or damaged, in which case your statutory rights apply.
19. Liability – Nothing in these terms & conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under Irish law, and nothing in these terms affects your statutory rights as a consumer. Subject to the above, we will not be liable for any failure or delay in delivering goods you have ordered, or for any damage or defect to goods delivered, that is caused by any event or circumstance beyond our reasonable control. We are not liable for losses that were not foreseeable to both parties when the contract was formed, or for business losses, as this website is intended for consumer use only.
20. Governing law – These terms & conditions, and any contract between you and us, are governed by the laws of Ireland and the Irish courts have jurisdiction, except that if you are a consumer resident elsewhere in the European Union you may also rely on the mandatory consumer protection rules of your country of residence.
21. Complaints – We hope that you are happy with your shopping experience at guineys.ie but if you are unhappy with any aspect of our service, please email us at [email protected] and we will do our best to resolve the matter. If you are not satisfied with our response, you may contact the Competition and Consumer Protection Commission (CCPC) for information on your rights, or refer the dispute to an approved alternative dispute resolution body.
